Counterfeit Warning
Counterfeit magazines are being produced and distributed by a company called "PEBKAC PTY LTD". The company is using the trading name, "Australian Sun and Health."  Note the slight difference in name... 'and' -vs- '&'.

At least two people are involved in production of the counterfeit  magazines - Mark Dixon (sole owner of the company) and Sarah Scriven (employed in the position of Editor).

The magazines are being produced using the title "Australian Sun and Health". The first issue of the magazine, entitled issue 1, is believed to have been released in September 2006 and circulated directly through Naturist organisations.

Don't be fooled...
they are not the real 'Australian Sun & Health' magazine!

A notice has been served on the company to 'Cease & Desist' with production of the magazine.

The matter has been referred to IP Australia for infringements relating to the trade mark and also to the New South Wales Office of Fair Trading for investigation into production of counterfeit magazines and obtaining monies by deceptive and fraudulent means. It will also be referred to the ACCC as the matter progresses through IP Australia. These are very serious infringements.

The counterfeit magazines are illegal!

Pebkac Pty Ltd have not been granted the right to exploit the copyright or trademark of Australian Sun & Health, which is solely owned by myself, Rod Tyldsley. Production of the magazine is unlawful as it infringes on the rights of the owner (myself), including statutory and common law protections relating to trade mark infringement, unfair competition and possible copyright infringement.


If you have purchased the magazines for the purpose of  re-selling them...

STOP!


Were you informed that Australian Sun & Health became defunct in 2005?

Were you informed that a new company had 'purchased' the business name and were producing an all new Australian Sun and Health?


Were you informed of issues relating to reliability, timeliness, quality and delivery of AS&H?
Did they forget to mention that Sarah Scriven (previously Tyldsley)  was also responsible for those problems?

Did they forget to mention that Sarah Scriven was also responsible for many of the delays in producing issue 86 of the real Australian Sun & Health magazine?


Did they forget to mention that in August 2006 (this year) Sarah Scriven finally agreed to resolve the partnership problems that were delaying production of AS&H issue 86
?  

Did they 'guarantee' that their new magazine would be available from September 1st?  Was it
?

Did they explain why they changed the name from "Australian Sun & Health" to "Australian Sun and Health"?


Did they tell you that issue 86 of the real Australian Sun & Health magazine was being published in December 2006
?

Were you convinced to  purchase their magazine, contribute an article or possibly even advertise in it, believing their magazine to be the real Australian Sun & Health? 


If you have fallen prey to any of the above...

I'm sorry, but you have been deceived!

Please immediately contact the New South Wales Office of Fair Trading.

You should also request an immediate return of any contributions you have forwarded and/or a refund of any monies you have paid to Pebkac Pty Ltd trading as Australian Sun and Health.

Unfortunately, if you are a consumer and have purchased the magazine you may not be entitled to a refund as, according to the Office of Fair Trading, "it is the consumers responsibility to be well informed about the product they are purchasing". Of course, you are more than entitled to lodge a complaint.

To the many, many people who have contacted me and offered their support, I offer my sincere thanks. It is support such as yours that has kept AS&H alive.
